Parties are neighbors. Plaintiff claims he was mowing the lawn, and defendant for no reason assaulted him, he was in a bad mood kicking trash cans outside his home. Defendant claims they have had problems before. plaintiff claims the day of the incident he said some words not loud and defendant came up to him asking what he said and assaulted him on his side of the fence. Defendant denies instigating fight. Both showed pictures of their injuries.
