Parties are a divorced couple. Plaintiff claims defendant vandalized his car. They have a child in common, share visitations and custody. Defendant claims that the day of the incident she sent a text to plaintiff to pick up their son from her that day as it was his time with him, she was off from school, plaintiff was upset because he knew she was off, they argued over the phone. Plaintiff claims that after they hung up the phone, she called him to say she was outside his apartment to give him their son, he told her he was at a friends house and did not take his car. Defendant denies it. Plaintiff continues saying that she threaten to damage his car if he does not come out. He kept telling her not to do anything to his car, she said she did not care. He went home, called the police on his way there. Witness on the court confirmed he saw the defendant scratching the car.
