Parties are coworkers. Plaintiff claims defendant owes him $4300 for late fees, and, the rest of it for a loan he gave to her brother that she was supposed to guarantee, the brother passed away, was supposed to be paying $500 a month. Nothing in writing from defendant, he received 2 checks from her. Later on, she asked him for another $4000 loan, was supposed to be for 6 months only, with terms of $100 a month for late fees. Defendant paid him $4000 4 years late, she gave him $100 for extra fees as she thought that is what it was. Judge told plaintiff he cannot sue for loan sharking interest, more than 27 percent is a criminal problem, he did 30. Defendant claims is not for interest, its for late fees.
